General Terms and Conditions

These general terms and conditions (hereinafter "T&Cs") of Gigi Bistro GmbH, Churerstrasse 160b, 8808 Pfäffikon SZ (hereinafter "Gigi Bistro"), govern the rights and obligations of users (hereinafter "customer") in connection with orders placed via the QR webshop and loyalty app of Gigi Bistro.

Gigi Bistro reserves the right to amend these T&Cs at any time and to publish the current version on this website.

These T&Cs apply to all orders placed by customers via the Gigi Bistro QR webshop at the Bahnhofstrasse 5, 8810 Horgen location. They can be viewed, downloaded and printed on this page at any time.

By submitting an order in the QR webshop, the customer places a binding order. Confirmation of receipt is provided immediately after the order is submitted, generally sent electronically by the order system provider OrderMonkey.

The customer agrees to provide truthful, current and complete information on the order form. Gigi Bistro is not liable for any loss or damage arising from failure to comply with this obligation.

Orders can currently only be picked up at the Bahnhofstrasse 5, 8810 Horgen location; delivery is not currently offered. There is no entitlement to a refund if perishable goods are not picked up on time.

Gigi Bistro plans to additionally offer delivery through the partner UberEats in the future. Once this service becomes available, the then-current terms and conditions of UberEats will apply in addition.

Age restriction for alcoholic beverages: A minimum age of 16 is required to purchase beer, wine and cider. A minimum age of 18 applies to the purchase of spirits, aperitifs and alcopops. By ordering alcoholic beverages, the customer confirms that they have reached the legally required minimum age.

Gigi Bistro reserves the right to carry out an age check at pick-up. If the customer cannot prove their age, Gigi Bistro is entitled to refuse to hand over the alcoholic products and to cancel these items.

Prices are stated in Swiss francs (CHF). Gigi Bistro reserves the right to change prices at any time; the prices published in the QR webshop on the order date apply.

Payment is processed digitally via the payment service provider Nexi Schweiz AG. Nexi offers various payment methods, including TWINT as well as common credit and debit cards.

Gigi Bistro only collects the data strictly necessary for order processing and the loyalty programme. Further details are set out in the privacy policy.

Gigi Bistro uses ingredients and additives that may cause allergic reactions or intolerances. Customers are advised to inform themselves about the ingredients of our food and beverages; if in doubt, we recommend contacting hello@gigibistro.ch directly.

Liability for slight negligence as well as for indirect or consequential damages is excluded to the extent permitted by law. Gigi Bistro is not liable for temporary unavailability of the QR webshop or the loyalty app.

Gigi Bistro's loyalty programme is technically provided by Leat and is tied to a registered account in the loyalty app. Points are personal, non-transferable and cannot be paid out in cash.

Should individual provisions of these T&Cs be invalid, the validity of the remaining provisions shall remain unaffected.

Swiss law applies exclusively. Subject to any mandatory statutory place of jurisdiction, the exclusive place of jurisdiction for any disputes arising from the business relationship is the registered seat of Gigi Bistro GmbH in Pfäffikon SZ.
